For an uncontested Divorce No ( if Contested Yes ) only ONE party ( either husband or wife ) MUST be an Alabama resident for at least Six ( 6 ) months prior to filing a Divorce in Alabama . If you live elsewhere , but your spouse is an Alabama resident ( and will cooperate ) then our Alabama Divorce Online process will also work for you .We have divorced many Alabama residents where the other party lived in Africa / Asia /Caribbean / Canada / Mexico / South America / Caribbean  and most every other state in the USA  - they simply must be able to access the internet wherever they may be .

Uncontested - where other websites do not disclose this - we try to be as transparent as possible and work off a Flat Fee arrangement . We allow 90 days from initial payment to complete the process ( make all payments in full ) , return all necessary documents to file with the court in an expeditious manner - YOU must follow our instructions and cooperate with us ( sign documents promptly & return ! ) to keep your fee low .  Cases that require our additional time over the normal ( this is rare ) or miss the 90 day deadline ae subject to additional fees . Court Filing fees ( typically approximately $250 if not waived by the court ) are additional fees ( non-attorney ) that are required for any civil action in Alabama Courts. There may be nominal electronic payment fees and / or financing fees if you choose the "Pay Later" option via "Affirm" financing. Also unless you know a Notary at your bank , library who will witness for FREE you will have to Pay an online or in person Notary from $25 and up for their independent services.  Contested Divorce Service are offered as Unbundled Pro Se assist  which very well may exceed $500 if required.

If you and your spouse have biological or adopted children under the age of 19 together as a couple then they must be addressed in a divorce action . Issues such as custody & child support are paramount and MUST be in your documents . As the average cost of properly raising a child is now estimated to be over $300k until adulthood ( not including any post high school education) the Courts take a vested interest in what is in the best interest of the child. This is NOT a matter that should be taken lightly . We often are approached by parties that did not have their divorce handled properly initially and years later becomes a SERIOUS & Expensive problem . Your appearance in such cases will be REQUIRED in Open Court by the Circuit Court Judge in this type of case . In a "Pro Se" case you will not have the assistance of counsel in open court . "Pro Se" is a Latin term that the Courts use for parties appearing or filing a case without  an Attorney of Record.  In Alabama, attorneys can engage in "limited scope representation" (also known as "unbundling") where they agree with a client to provide specific, limited services, rather than full representation, as outlined in Rule 1.2 of the Alabama Rules of Professional Conduct.  

If you know where your spouse is and they are simply uncooperative for any reason nobody can force them to sign uncontested divorce papers . You will be forced to File a contested divorce action with the Court and have them "served" with divorce papers by the Sheriff or Private Process Server , whereupon you might simply obtain your divorce by default . If not it could turn into a protracted legal battle . Most Attorneys thus will require a $2500 ,$5000 , $10,000+ retainer fee depending on the assets / liabilities / custody in play ,  For simpler non complex cases we offer a "Pro Se" assist program from $500 ( NO attorney will represent you in court ) to assist in cases where a default judgment is likely . in Alabama there is a thirty ( 30 ) day mandatory waiting period before a Judge will Issue a Final Order of Divorce once ALL the necessary documents are properly Filed & Accepted by the Court.  Clients in simple uncontested cases who make sure we have their filing fee promptly and all the required documents back quickly often have their divorce finalized shortly after the 30 day waiting period , 45 -60 days is average . Yes !  If Uncontested  ! The Courts in Alabama are now more accepting of online electronic signatures notarized by a sanctioned Notary Public as a legal witness or it's overseas equivalent .  For years we simply emailed the documents to our clients who then printed / signed before a Notary ( typically separately )  and then used the Adobe Scan App on a smartphone to scan the executed document and return it to us so as the Attorney of Record we can E-File with the Court . Now you can simply do it all online with the assistance of an online Notary Service         ( additional fee ) such as notarize.com , many people know a local Notary who will witness for FREE or cheap ( $5 to $25) such as someone at their bank , library , etc. - but you would have to print your documents out for a "wet" signature in their presence. Regardless we take pride in providing step by step client service by phone / text / email to make the process as easy & simple as possible.  If you are NOT tech savvy No Worries , We will find a way to assist you thru the process.
